    A correspondent attorney is an attorney who receives and executes instructions from an instructing attorney because the address of the instructing attorney is outside of the jurisdiction of a specific court. The correspondent attorney attends to the instructions received from the instructing attorney in the same manner as the instructing attorney would.

    Why is it necessary to appoint a Correspondent attorney?

    If a client needs to issue summons or an application and the address of the instructing attorney is not within a specific distance from the court where the summons or application needs to be issued, the attorney need to appoint a correspondent attorney. If the address of the instructing attorney exceeds 15 kilometers from the courthouse in South Africa, he or she needs to appoint a correspondent attorney.

    The instructing attorney is the attorney a client approaches for legal assistance who accepts the instructions of a client to execute the instructions.

    Who is the correspondent attorney?

    A correspondent attorney is an attorney that is appointed by the instructing attorney who is situated within a radius of 15 kilometers from the courthouse in which a legal action should be instituted.

    What are the duties of a correspondent attorney?

    The correspondent attorney have more or less the same duties of that the instructing attorney has. The correspondent attorney should attend to the instructions of the instructing attorney in the same manner, skill, care, professionalism and urgency as the instructing attorney would have done. The duty of care on the instructing attorney is the same as the instructing attorney.

    Who is the client?

    The person or company that requires legal assistance or legal services is the client of the instructing attorney. The instructing attorney is the client of the correspondent attorney.

    Who pays for the services of a correspondent attorney?

    The instructing attorney is liable for the fees and disbursements of the correspondent attorney. The instructing attorney pays the correspondent attorney and in turn, collects the money from the client if the instructing attorney does not hold sufficient money in his or her trust account for the benefit of the client.
